1. SPONSOR: The Sponsor of the JetBlue 2023 GreenUp Sweepstakes (the “Sweepstakes”) is JetBlue Airways Corporation, located at 27-01 Queens Plaza North, Long Island City, New York 11101 (“Sponsor” or “JetBlue”).
2. ELIGIBILITY: This Sweepstakes is open to legal residents of the fifty (50) United States, the District of Columbia, and Puerto Rico who are eighteen (18) years of age or older at the time of Entry/Game Play (each an “Entrant”). Void in the U.S. Virgin Islands and other U.S. Territories and Possessions and where prohibited, taxed or restricted by law. Employees, officers, directors, shareholders, agents and representatives of Sponsor, Don Jagoda Associates, Inc. (“Sweepstakes Administrator”), Earthday.org (“Sweepstakes Partner”), and their respective parents, subsidiaries, affiliates, divisions, advertising and Sweepstakes and/or fulfillment agencies (collectively, the “Related Entities”) and the immediate families (spouse and parents, step parents, children, step children, siblings, grandparents and their respective spouses, regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to participate in this Sweepstakes.
3. SWEEPSTAKES PERIOD: The Sweepstakes begins on or about 12:00:00 AM Eastern Time (“ET”) on April 3, 2023 and ends at 11:59:59 PM ET on April 30, 2023 (“Sweepstakes Period”). Sweepstakes Administrator’s database clock is the official time keeping device for the Sweepstakes. Sponsor may modify the validity of the Sweepstakes, which will be previously registered and notified before the competent authority, if applicable, and communicated in a timely manner by the means that the Sponsor deems appropriate. Likewise, for reasons beyond the reasonable control of the Sponsor, the Sponsor may cancel or suspend the Sweepstakes, which will also be communicated in a timely manner, without any liability to JetBlue.
4. HOW TO ENTER: Entrants may enter the Sweepstakes during the Sweepstakes Period by visiting www.jetbluegreenup.com (the “Website”) and completing and submitting an online registration form as directed by providing their first name and a valid email address to receive one (1) primary entry into the Sweepstakes (“Primary Entry”). Limit one (1) Primary Entry per person/per email address. After submitting their Primary Entry, they may follow the onscreen instructions to complete the following actions to earn additional entries into the Sweepstakes (“Additional Sweepstakes Entries”), as follows:

Memory Match [earn up to twenty (20) Additional Sweepstakes Entries]: Entrants may earn five (5) Additional Sweepstakes Entries into the Sweepstakes each week by completing the Memory Match on the Website. Entrants may choose to click the “Skip” button and still gain the Additional Sweepstakes Entries. Entrants may complete this action four (4) times/ one (1) per week during the Sweepstakes Period For a maximum of twenty (20) Additional Sweepstakes Entries.
6. Earthday.org Newsletter Sign Up [earn one (1) Additional Sweepstakes Entry]: Entrants may earn one (1) Additional Sweepstakes Entry into the Sweepstakes by clicking to sign up for email updates from Earthday.org. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter. Entrants may complete this action only one (1) time for the entire Sweepstakes Period.
7. Register Your 2023 Great Global Cleanup [earn ten (10) Additional Sweepstakes Entries]: Entrants can earn ten (10) Additional Sweepstakes Entries into the Sweepstakes for registering for a 2023 Great Global Cleanup during the Sweepstakes Period at www.earthday.org/jetblue. You must click to agree to leave www.jetbluegreenup.com and go to www.earthday.org/jetblue, which is not operated by JetBlue. Sponsor and Sweepstakes Administrator are not responsible for the content or availability of linked sites. Information provided at www.earthday.org/jetblue is subject to Earthday.org’s Privacy Policy. Visitors to www.earthday.org/jetblue who have not submitted a Primary Entry at www.jetbluegreenup.com and register a 2023 Great Global Cleanup during the Sweepstakes Period will receive ten (10) Additional Sweepstakes Entries if they opt-in to participate in the Sweepstakes and acknowledge that they have read and agree to these Official Rules. Entrants may complete this action only one (1) time for ten (10) Additional Sweepstakes Entries, regardless of how many 2023 Great Global Cleanup Registrations they submit at www.earthday.org/jetblue.
8. Instant Win Game [chance to win one (1) prize instantly]/Verification: Entrants will have the opportunity once per week during the Sweepstakes Period to spin a wheel (“Game Play”) for an instant win prize (prizes broken out down below). Spinning the wheel does not earn them an extra Entry into the Grand Prize drawing. Limit one (1) Game Play per person per week during the Sweepstakes Period. A “week” is defined as each Monday through Sunday for the four (4) weeks of the Sweepstakes Period. Limit one (1) Instant Win Prize per Entrant for the Sweepstakes Period. Entrants may not win more than one (1) Instant Win Game prize, however, Entrants who win an Instant Win Game prize are still eligible to win a Sweepstakes Prize if they earned entries into the Sweepstakes Prize drawing as mentioned above. If winner is determined to be an instant winner, they will receive a prize winning message including next steps for verification and/or prize award. All winning Game Plays are subject to verification. If, due to an error of any kind, more instant winning messages are delivered to Entrants, or more prizes are claimed than are intended to be awarded, the intended number of prizes will be awarded in a random drawing from among all verified prize claims received each week during the Sweepstakes Period. In no event will more than the stated number of prizes listed in these Official Rules be awarded.
9. Hereinafter, Primary Entries and Additional Sweepstakes Entries are collectively referred to as an “Entry” or “Entries”). LIMIT ONE (1) PRIMARY ENTRY AND UP TO THIRTY-ONE (31) ADDITIONAL SWEEPSTAKES ENTRIES PER ENTRANT.
10. In the event of a dispute as to the identity of an Entrant, the Entry/Game Play will be declared made by the “Authorized Account Holder” of the e-mail address provided at the time of Entry/Game Play and he/she must comply with the Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable service provider has assigned the e-mail address. Any attempt by any Entrant to obtain more than the stated number of Entries/Game Plays per Entry/Game Play method by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant's Entries/Game Plays and that Entrant may be disqualified. Use of automated Entry/Game Play or similar devices to participate or subvert the Entry/Game Play process is prohibited and all Entries submitted through such devices are void. All Entries/Game Plays become the property of the Sponsor upon submission and will not be acknowledged or returned and the Sponsor has the right to dispose of the Entries at Sponsor’s discretion. If you use a mobile device to enter this Sweepstakes, message and data rates may apply, and Entrants will be solely responsible for any and all applicable charges. Please consult your wireless-service provider regarding its pricing plans. By submitting an Entry/Game Play, each Entrant agrees to abide by the terms of these Official Rules, the decisions of the Sponsor which are final and binding in all matters relating to this Sweepstakes, and the JetBlue’s Privacy Policy. ALL ENTRIES/GAME PLAYS MUST BE RECEIVED BY 11:59:59 PM ET ON APRIL 30, 2023.
11. SWEEPSTAKES prize WINNER SELECTION/RANDOM DRAWING: One (1) potential Grand Prize winner, one (1) potential First Prize winner, and twenty (20) potential Second Prize winners will be selected in a random drawing from among all eligible Entries received during the Sweepstakes Period through the use of Sweepstakes Administrator’s proprietary computerized random generator system. The random drawing will be conducted on or about May 3, 2023 by Sweepstakes Administrator, an independent judging organization. Odds of winning a prize depend on the number of eligible Entries received during the Sweepstakes Period.
12. NOTIFICATIONS/LIMITATIONS: Potential prize winners will be notified via email to the email address provided at the time of Entry/Game Play by Sweepstakes Administrator. Potential Grand and First Prize winners will be required to digitally complete and submit a Declaration of Compliance, Liability Waiver and, unless prohibited by law, a Publicity Release within seventy-two (72) hours from date of notification to claim a prize. Potential Second Prize winners and Instant Win Game travel certificate winners will be required to complete and return a Prize Verification Form including a Liability Waiver and, unless prohibited by law, a Publicity Release within seventy-two (72) hours from date of notification to claim a prize. In order to be declared an official prize winner in the Sweepstakes, each potential prize winner is subject to verification of eligibility and compliance with these Official Rules. Entrants agree to be bound by the decisions of the Sponsor and the Sweepstakes Administrator, which are final and binding on all matters pertaining to the Sweepstakes. Instant Win GreenUp Goodie Bag winners will be sent their prizes within 6-8 weeks after verification. A potential prize winner may be disqualified if: (i) required execution of winner notification materials are not received by Sweepstakes Administrator in a timely manner, (ii) a potential prize winner is ineligible or is otherwise not in compliance with these Official Rules, (iii) a potential prize winner declines his/her prize, or (iv) prize is returned as undeliverable. In the event a potential prize winner is disqualified, an alternate prize winner will be selected in a random drawing from among all remaining corresponding eligible Entries received (for the Sweepstakes prizes). A selected potential prize winner will not be an official prize winner until all required documentation has been returned, and eligibility has been formally verified. Sponsor is not responsible for fraudulent calls or emails made to Entrants or prize winners not by Sponsor or Sweepstakes Administrator. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for any recipient who receives a prize if the annual aggregate value of the prize received is $600 or more. Potential Grand and First Prize winners will be required to provide Sponsor with his/her Social Security number for tax purposes and will receive an IRS Form 1099-MISC for the ARV of the prize.
13. PRIZES AND THEIR APPROXIMATE RETAIL VALUES (“ARV”):
14. ONE (1) GRAND PRIZE: Grand Prize consists of two (2) JetBlue Mint Fare Travel Certificates (refers to first class flights, to be used in the countries where said Mint flights are available, each Travel Certificate redeemable for one (1) JetBlue Mint Fare round-trip flight (inclusive of all taxes and fees), valid from any city to any city that JetBlue flies to, in accordance with the terms and conditions as delivered with such Travel Certificates. (Travel Certificate conditions included herein). The ARV of the Grand Prize is up to $5,000.
15. ONE (1) FIRST PRIZE: First Prize consists of one (1) JetBlue Vacations Package consisting of two (2) JetBlue Blue Fare Travel Certificates, each redeemable for one (1) JetBlue Blue Fare round-trip flight (excluding taxes and fees), valid to/from any JetBlue Vacations City destination city, in accordance with the terms and conditions as delivered with such Travel Certificates (you can find more information about this rate at https://www.jetblue.com/flying-with-us/our-fares), and one (1) $500.00 hotel credit in the JetBlue Vacations Package destination city of First Prize winner’s choice. Prize winner will assume sole responsibility for all costs associated with any elements of the prize not explicitly included as part of prize description, including without limitation, any and all accommodation costs above $500 hotel credit which must be paid by a credit card at the time of booking. The ARV of the First Prize is up to $1,000.
16. TWENTY (20) SECOND PRIZES: Each Second Prize consists of two (2) JetBlue Blue Fare Travel Certificates, each redeemable for one (1) JetBlue Blue Fare round-trip flight (excluding taxes and fees), valid from any city to any city that JetBlue flies to, in accordance with the terms and conditions as delivered with such Travel Certificates (you can find more information about this rate at https://www.jetblue.com/flying-with-us/our-fares). The ARV of each Second Prize is up to $500.
17. INSTANT WIN GAME PRIZES:
18. FOUR (4) TRAVEL CERTIFICATES [One (1) awarded per week]: Each Travel Certificate Prize consists of two (2) JetBlue Blue Fare Travel Certificates, each redeemable for one (1) JetBlue Blue Fare round-trip flight (excluding taxes and fees), valid from any city to any city that JetBlue flies to, in accordance with the terms and conditions as delivered with such Travel Certificates (you can find more information about this rate at https://www.jetblue.com/flying-with-us/our-fares). The ARV of each Prize is up to $500.
19. EIGHTY (80) GREENUP GOODIE BAGS [Twenty (20) awarded per week]: each GreenUp Goodie Bag will consist of one (1) JetBlue bag, one (1) utensil set, and one (1) water bottle, ARV for each Instant win prize: $42.00.
20. Unclaimed Instant Win Prizes will not be awarded.
21. TOTAL ARV OF ALL PRIZES AVAILABLE TO BE AWARDED: up to $21,360.
22. General Prize Conditions: All prizes include carbon offset through JetBlue’s partnership with Carbonfund.org. With regard to the availability of the seats and flights in which the travel certificates will be used, the winner acknowledges that given the nature of the prize and its characteristic of variability over time, not all flights and schedules may be chosen, but said selection may be made based on the availability of each particular flight indicated by JetBlue at the time the certificate is used. All federal, state and local taxes on prizes are the sole responsibility of the individual prize winners. The ARV of the prizes set forth above represents Sponsor’s good faith determination of the retail value thereof, and the actual fair market value, as ultimately determined by Sponsor, is final and binding and cannot be challenged or appealed. In the event the stated ARV of a prize is more than the actual fair market value of the prize due to itinerary and/or market fluctuations, the difference will not be awarded in cash or otherwise. Any portion of a prize not used by a prize winner is forfeited and no cash substitute will be offered or permitted. Prize winners are solely responsible for any costs and expenses associated with prize acceptance and use not specific herein as being provided, including but not limited to any travel to/from JetBlue network airport. Prizes do not include and are exclusive of taxes, fees, service charges, miscellaneous in-flight expenses, and any other personal expenditure. Any costs associated with a prize not specified above are at the winner's discretion and are not included. Prize winners and guests must possess valid government-issued travel documents, VISA’s, passports, etc. at the time of travel. Sponsor will not be responsible for replacement of any lost or stolen airline tickets, boarding passes, or other flight documentation once they are in prize winner's possession. Sponsor is not responsible for any postponement, delays, or cancellation of air travel in connection with the prize. No refund or compensation will be made in the event of such occurrences. All travel is subject to any and all advisories, restrictions or requirements instituted by the U.S. Department of Defense, the U.S. Department of Homeland Security and/or the U.S. Centers of Disease Control and Prevention, as required, including but not limited to passing one (1) or more COVID-19 antigen and screening tests and testing negative for COVID-19 and executing any assumption of risk or other documents relating to COVID-19. No substitution for prize permitted, except by Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value for any reason. Prizes cannot be transferred or redeemed for cash. No more than the stated number of prizes will be awarded. Prizes are awarded "as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor's sole discretion. Limit one (1) Instant Win Prize and one Sweepstakes Prize per person.
23. Travel Certificate Terms and Conditions: Each Travel Certificate is good for one-time use by one person in accordance with the travel restrictions identified on or in connection with the Certificate. All travel must be booked and flown within the specified validity dates. In the event that a Travel Certificate does not include dates of validity, the Certificate shall be good for travel booked and flown within one (1) year of the date of issuance. If specific flights or departures/destinations are not identified on or in connection with the Travel Certificate, the Certificate may only be redeemed for one-way JetBlue flights to/from JetBlue cities. (Not all JetBlue cities connect; call 1-800-JETBLUE (538-2538) for information on connecting cities.) Redeemed travel is subject to availability, blackout dates, and capacity controls (flights to/from Caribbean destinations subject to heightened capacity controls), and seats may not be available on all flights. Flight schedules are subject to change without notice. Certificate is not valid for bookings on Mint, partner airlines or code share or interline flights or for use in connection with JetBlue Vacations packages, cruises or any other products or services. Certificate is transferable; however, at no time may it be purchased, sold, bartered, traded on an auction website or otherwise exchanged for value without prior written consent from JetBlue. Certificate cannot be partially redeemed, is not redeemable for cash, and has no cash value. Customers are subject and entitled to all provisions of JetBlue’s Contract of Carriage. If traveling outside of the United States of America, Customers are responsible for any and all documentation requirements, including but not limited to, proof of citizenship and all applicable visa requirements. For travel to Cuba, each Customer must comply with regulations administered by the United States Office of Foreign Assets Control (OFAC) and is solely responsible for certifying that his or her trip is authorized under at least one of the OFAC approved license categories, and for determining the type of and obtaining any applicable visa. JetBlue is not responsible for a Customer’s failure to present or provide adequate travel documentation required by the applicable laws of the territories a Customer is traveling to or from. Government taxes and fees apply to travel booked using a Certificate, are the responsibility of the customer, and will vary based on route. For travel to Cuba, the fees payable will include Cuban government-required health insurance coverage provided by Asistur, the terms and conditions of which can be accessed from the ESICUBA website. Government taxes/fees are subject to change as required by law. Customer must pay all applicable taxes and fees using a major credit card at the time of booking. Customer is solely responsible for fees for any oversized, overweight or extra baggage and fees for products/services sold separately, such as Even More Space seats, pet fees, etc. To view baggage fees and other optional services and fees, see http://www.jetblue.com/legal/fees/. A Travel Certificate may be redeemed only by calling 1-855-337-9612 and providing the authorization number and PIN number included on the Certificate. Travel Certificates may not be redeemed at airport ticket counters or online. The authorization number and/or PIN number cannot be replaced if lost or stolen (except as required by law), and JetBlue is not responsible for lost or stolen Travel Certificates, authorization numbers or pin numbers. Customers will not be able to redeem their Travel Certificate without the authorization number and PIN. Redeemed travel is not eligible for TrueBlue points. (TrueBlue is JetBlue’s loyalty program.) 24. WAIVER OF LIABILITY AND RELEASE: By participating in the Sweepstakes and submitting an Entry/Game Play, each Entrant waives, discharges, and fully releases Sponsor, Sweepstakes Administrator, Sweepstakes Partner, the Related Entities, and the officers, directors, shareholders, agents and representatives of each (collectively, the “Released Parties”) from any and all liability, injury, damage or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Sweepstakes or from the receipt or use of any prize or from any activity related to the receipt or use of any prize (including any travel or activity related thereto). By receipt of any prize, each prize winner agrees to release and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize (including any travel or activity related thereto) and assumes the risk(s) of traveling to a city other than his/her own and a potentially heightened risk of exposure to communicable diseases, viruses, bacteria or illnesses (including, without limitation, COVID-19) and the causes thereof, and sickness arising as a result of a winner and/or guest participating in the Sweepstakes and related activities, wherever, whenever or however the same may occur. Each winner and his/her/their guest fully understands that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including the protocols that may be implemented from time to time based upon public health and government-sponsored guidelines (collectively, the “Protocols”), can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition. 
25. FORCE MAJEURE: In the event an insufficient number of eligible Entries are received for the Sweepstakes Period and/or Sponsor is prevented from awarding any prizes or continuing with this Sweepstakes as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health or other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, regulation, or guideline, public health crisis (e.g., Coronavirus), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate this Sweepstakes. If this Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the potential Sweepstakes winners in a random drawing from all eligible, non-suspect Entries received as of the date of the event giving rise to the termination or as otherwise deemed fair and appropriate by Sponsor and award all Instant Win Prizes claimed prior to cancellation. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. If the Sponsor determines that all or a portion of a prize is unavailable due to a Force Majeure event, then Sponsor reserves the right to substitute the prize or portion thereof with one of equal or greater value, and no other additional compensation or substitution will be provided.
26. PUBLICITY: Except where prohibited, prize winners by acceptance of a prize, grant to the Released Parties the right to publicize his/her name, city and state of residence, Entry/Game Play (or any portion thereof), photograph, video, voice, statements and/or other likeness and prize information in any and all media now known or hereafter devised, for advertising, trade and other purposes, throughout the world, for up to one year from the time of acceptance, in any manner, without limitation and without additional compensation, consideration, notification or permission, unless prohibited by law.
27. LIMITATIONS OF LIABILITY: Released Parties are not responsible for stolen, late, incomplete, inaccurate, stolen, misdirected, lost, damaged, garbled, delayed, incomplete or garbled Entries or email; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes the processing of Entries/Game Plays, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to Entrant's or to any other person's computer, wireless phone/smartphone or landline phone related to or resulting from participating in this Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other Entrant or any representative of Sponsor and/or the Released Parties, or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, and their respective agents. Sponsor shall have the sole right to disqualify any Entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes and to resolve all disputes in its sole discretion.
28. GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify the prize winners and award the prizes by random drawing from among all non-suspect, eligible Entries received up to the time of such cancellation or in another manner otherwise deemed fair and appropriate by Sponsor and award all Instant Win Prizes claimed prior to cancellation. Sweepstakes is subject to all applicable federal, state and local laws and regulations.
29. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE SWEEPSTAKES OR TO UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
30. DISPUTES: By entering the Sweepstakes, each Entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or the prize awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, and in no event will Entrant be entitled to receive attorneys' fees or other legal costs; and (c) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York, except for the case of Participants residing in the Dominican Republic, in which case it will be interpreted in accordance with the laws of the Dominican Republic . Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of New York, County of New York, and the parties’ consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
31. USE OF INFORMATION: Participation in the Sweepstakes constitutes consent to (i) receiving email correspondence from Sponsor and (ii) to the transfer of the personal information collected from you by the Sponsor to Earthday.org for the purposes of administering the Sweepstakes and for such other purposes to which Entrant may consent as outlined herein or at www.jetbluegreenup.com. All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with the JetBlue’s Privacy Policy which may be updated from time to time without notice.
32. RIGHTS RESERVED: The content, information, data, designs and code associated with the Sweepstakes and at www.jetbluegreenup.com are protected by intellectual property and other laws. Any unauthorized use of copyrighted materials, trademarks, or any other intellectual property of Sponsor and/or Sweepstakes Administrator without the express written consent of its owner is strictly prohibited.
